Capital: Del. McConkey to face jury

After being accused of fraud and misrepresentation, Del. Tony McConkey (R-Severna Park) will face a jury in November according to The Capital.

A judge ruled last week that McConkey violated the law when he bought a home facing foreclosure.  Circuit Court Judge D. William Simpson says that McConkey's purchase of Teresa Milligan's home was illegal because he was acting as a consultant.

Simpson ruled that the purchase violated the Protection of Homeowners in Foreclosure Act, a law McConkey signed for in 2005 and then again in 2008 when it was amended.

McConkey argues that he was trying to help Milligan save her home, and if he violated the law, then the law is wrong.

"The only victim in this whole thing is me. I am out 30 grand," McConkey told The Capital.

The Annapolis based daily also noted McConkey's past legal issues. His record includes a battery charge in 1992 resulting in probation and a voluntary disbarment as an attorney in 1995 for misappropriation of funds. McConkey argues the 1992 charges were a result of a tenet claiming McConkey didn't have permission to enter the basement he was renting out in his own home .
